Introduction
The website at proactivetech.pro and the pages made available through it (the "Website") are operated by PRO ACTIVE TECH LTD ("we", "us", "our" or the "Company"), a private limited company incorporated in England and Wales under company number 17444394, with its registered office at 2nd Floor College House, 17 King Edwards Road, Ruislip, London, HA4 7AE, United Kingdom.
By accessing or using the Website you confirm that you accept these Terms and agree to be bound by them. If you do not accept them, you must stop using the Website immediately.
These Terms cover use of the Website only. If you apply for, open or maintain a trading account, the products, orders, pricing, payments and the account relationship itself are governed by the Client Agreement, Risk Disclosure and the other documents you accept during onboarding. Where there is any inconsistency on a trading matter, those documents prevail, and these Terms continue to apply to your use of the Website.
Intellectual property
Unless stated otherwise, all content on the Website — including text, graphics, layouts, interfaces, software, code, data compilations, charts, images, video, logos, trade marks and trade names — is owned by us or licensed to us by the relevant rights holder. Our branding and marks may not be used without our prior written permission.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Website for your own personal use or legitimate internal business use. No ownership or other intellectual property right is transferred to you. All rights not expressly granted are reserved.
Restrictions on use
Except where we permit it in writing or the law requires it, you must not:
- Copy, reproduce, modify, republish, distribute, sell, sublicense or commercially exploit any part of the Website or its content;
- Use bots, scrapers, crawlers, data-mining tools or any other automated means to extract content, account data or personal data from the Website;
- Interfere with, overload or disrupt the Website, or reverse engineer or attempt to circumvent any security, authentication or access-control measure;
- Introduce malware, malicious code, denial-of-service traffic or anything else intended to damage or compromise the Website or another person;
- Attempt to gain unauthorised access to the Website, a trading platform, an account, a server or another user's information;
- Impersonate another person, misrepresent your identity or authority, or submit information you know to be false, misleading or fraudulent;
- Use the Website to infringe anyone's rights, to send unsolicited advertising, or for any unlawful, abusive or fraudulent purpose; or
- Use the Website in breach of applicable law, sanctions, these Terms or any Client Agreement you have entered into.
Account security
Any username, password, authentication code or other credential issued to you is confidential. You are responsible for keeping it secure and for all activity carried out using it.
You must notify us promptly at support@proactivetech.pro if you know or suspect that a credential has been compromised, or that someone has accessed your account without authority. We may require you to reset credentials or may suspend access while we investigate.
Your content
"Your Content" means any information, document, message, feedback or other material you submit through the Website. You confirm that Your Content is lawful, accurate so far as you are aware, and that you have the right to submit it.
You grant us a non-exclusive, worldwide, royalty-free licence to receive, host, store, reproduce and process Your Content only so far as reasonably necessary to operate the Website, respond to your requests, provide support, meet our legal and compliance obligations, keep records, prevent fraud and exercise our rights under these Terms. We may allow our service providers to process Your Content for those purposes under appropriate contractual obligations.
Personal data within Your Content is handled in accordance with our Privacy Policy. Nothing in this section permits us to publish your personal data, identity documents or confidential account information.
We may remove or refuse content that is unlawful, infringing, harmful or technically unsafe, but we are not obliged to monitor every submission. General feedback and product suggestions may be used to improve the Website, without affecting our confidentiality and data protection obligations.
Third-party content and links
The Website may display market data, news, analysis, charts or other material supplied by third parties, and may link to external websites. We do not control that material and do not endorse it.
Prices, quotes and charts shown on the Website are indicative only. They may be delayed, incomplete or different from the executable prices available on a trading platform. They must not be relied on for trading decisions.
Where we link to an external website, that site is governed by its own terms and privacy policy. We accept no responsibility for its content, availability or practices.
No warranties
To the fullest extent permitted by law, the Website is provided on an "as is" and "as available" basis. We do not warrant that it will be available without interruption, secure, free from error or harmful components, or that all information on it will be complete, accurate or current at all times.
Before making any financial decision you should read the applicable Client Agreement and Risk Disclosure, consider your own circumstances, and obtain independent professional advice where appropriate. Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, neither we nor our directors, officers, employees or agents will be liable for any indirect, incidental, special or consequential loss arising out of or in connection with your access to, use of, inability to use, or reliance on the Website — including loss of profit, revenue, business opportunity, goodwill or data.
Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded or limited. Where liability cannot be excluded, it is limited to the minimum extent the law permits.
Trading losses, order execution, slippage, margin calls, account closures and any other liability arising from a trading account or financial service are not governed by these Website Terms. They are dealt with in the Client Agreement and related documents.
Indemnification
To the extent permitted by law, you will indemnify us and our directors, officers, employees and agents against reasonable losses, liabilities, claims, damages and costs arising directly from your material breach of these Terms, your unlawful or fraudulent use of the Website, your infringement of a third party's rights, or the introduction of malicious code by you or through systems under your control.
This indemnity applies only to the extent the loss was caused by your conduct. It does not apply to loss caused by our fraud, wilful misconduct, negligence or breach of law. We will take reasonable steps to mitigate any recoverable loss.
Restricted jurisdictions
We do not offer our services to residents or citizens of the following jurisdictions, and we do not accept account applications from them:
Suspension of access
We may restrict, suspend or withdraw access to all or part of the Website where reasonably necessary to protect security, comply with a legal or regulatory requirement, investigate suspected misuse, or carry out maintenance or development work.
Where practicable we will give notice, but we may act without notice where the circumstances require it. Suspension or termination of a trading account or financial service is a separate matter governed by the Client Agreement.
Severability
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will be modified only to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision will be severed. The remaining provisions continue in full force and effect.
Variation of Terms
We may update these Terms to reflect changes in law, regulation, security requirements, technology, Website functionality or our business. The revised version will show the date it was last updated and takes effect when published, unless a later date is stated.
Where the law requires it, or where a change materially affects Website users, we will give reasonable notice through the Website or your registered contact details. Continued use after the effective date means you accept the revised Terms. If you do not accept them, you must stop using the Website.
A change to these Terms does not amend a Client Agreement unless that agreement is separately amended under its own provisions.
Assignment
You may not assign, transfer or subcontract your rights or obligations under these Terms without our prior written consent.
We may assign or transfer these Terms to an affiliate or successor as part of a lawful reorganisation, merger or transfer of the Website or the relevant business, provided this does not reduce any non-excludable rights you have under applicable law. This clause does not transfer a trading account or Client Agreement, which is governed separately.
Entire agreement
These Terms, together with the policies expressly referred to in them, form the entire agreement between you and us concerning your use of the Website, and replace any earlier understanding on that subject.
They do not replace or override the Client Agreement, Privacy Policy, Risk Disclosure, AML Policy, KYC Policy or Refund Policy. Each of those applies according to its own subject matter. A failure or delay by us in exercising a right does not waive that right. Headings are for convenience only and do not affect interpretation. Where a translated version is inconsistent with the English version, the English version prevails so far as the law permits.
Governing law and jurisdiction
These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of England and Wales.
Subject to any mandatory rights or jurisdiction available to you under the law of your country of residence, the courts of England and Wales have non-exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Website.
This clause applies to Website use only. The governing law and dispute-resolution process for a trading account or financial service are set out in the Client Agreement.

Risk Warning
Trading foreign exchange and contracts for difference is highly speculative, carries a substantial degree of risk, and is not suitable for every investor. These are complex, leveraged instruments. Leverage magnifies both gains and losses, and you may lose part or all of your invested capital. Before trading, consider your objectives, financial position, level of experience and appetite for risk, satisfy yourself that you understand how these products work, and trade only with money you can afford to lose. Seek independent financial or tax advice if you are in any doubt. Past performance is not a reliable indicator of future results.
